This award is for an apprentice who works from a usual place of work such as a workshop. If an apprentice has no usual workplace and moves from work site to work site, they will come under the Award Code 001 and be entitled to travel allowances and a higher pay rate.

Expense Related Allowances

Expense related allowances are effective from the beginning of the first pay period to commence on or after 11 September 2005.

Annual Holidays

The NSW Annual Holiday Act 1944 allows full-time and part-time employees in New South Wales to have four weeks paid leave per year.

Please remember - entitlements to annual holidays come from the Annual Holidays Act 1944. However, leave loading is an entitlement payable under most NSW Awards or Enterprise Agreements.   1. Expet as otherwise provided in this Act, every worker shall at the end of each year of the worker's employement by an employer become entitled to an annual holiday on ordinary pay.
  2. Such annual holiday shall:
  3. An annual holiday shall be given and taken either in one consecutive period or two periods which shall be of three weeks and one week respectively, or if the worker and the employer so agree, in either two, three or four separate periods and not otherwise.
  4. If the worker and the employer so agree, the annual holiday or any o such separate periods may be taken wholly or partly in advance before the worker has become entitled to the annual holiday.

Sick Leave

Apprentices

30.5.1 Each apprentice shall be allowed sick leave up to a maximum of a fortnight for each year of apprenticeship. Such sick leave shall be cumulative for the period of apprenticeship;

Provided that in the event of a transfer to another employer credit shall not be given for any balance of sick leave not taken whilst in the service of the previous employer.

30.5.2 For absence due to sickness of two days or less the parent or guardian shall notify the employer by thelephone and confirm the information by letter furnished on the day of resmption. Time lost for such absences shall not be paid for if the absence is not notified in the manner prescribed.

30.5.3 A medical cerfiticate shall be furnished for absence in excess of two days.

Sick lieae is an entitlement payable under most NSW Award or Enterprise Agreements.

Long Service Leave

The NSW Long Service Leave Act 1955 provides that full-time, part-time and casual workers in New South Wales are entitled to be paid long service leave after working for an unbroken period of ten years with an employer.

Two months paid leave after ten years service with one employer and one month paid leave for each additional five years service. Leave entitlements accrue pro rata on a daily basis for the first 15 years. After 15 years of service, only full years of service are taken into account for accrual purposes.

A worker who has completed five years' service is netitled to a long service pro rata payment if he or she:

  • resigns as a result of illness, incapacity, domestic or pressing necessity:
  • Is dismissed for any reson except serious and wilful misconduct;
  • Or dies.

Duties of Employers

(1) Employees

An employer must ensure the health, safety and welfare at work of all the employees of the employer.

That duty extends (without lomitation) to the following:

  1. ensuring that any premises controlled by the employer shere the employees work (and the means of access to or exti from the premises) are safe and without risks to health,
  2. ensuring that any plant of substance provided for use by the employees at work is safe and without risks to health when properly used,
  3. ensuring that systems of work and the working environment of the employees are safe and without risks to health,
  4. providing such information, instruction, training and supervision as may be necessary to ensure the employees' health and safety at work,
  5. providing adequate facilities for the welfare of the employees at work.

Training Requirements of Employers

Apprentices and trainees must be provided with "hands on experience". Appropriate facilities and training at work to acquire the knowledge and skills they need to complete the apprenticeship or training.

Apprentices and trainees must be enrolled in an approved course of formal taining with an RTO.

Apprentices and trainees must be allowed paid work time to undertake their formal training with an RTO unless the applicable award or agreement specifies otherwise. This will involve attendance at a training institution.

Employers must sign the apprentice /trainee's competency record book or work evidence guide which supports formal training.

Employers must liaise with the RTO regarding the apprentice/trainee's attendance and their participation in formal training.
